The severity of the alllegations is only one factor that a court looks at in setting a bond amount. The primary criteria is to what extent the defendant appears to be a flight risk. To evaluate, courts look at prior criminal record and whether there have been previous failure to appear warrants issued against them. My guess is that this guy had priors and the girl did not.

In multiple-perpetrator crimes, it is almost always the woman who is offered the plea deal in return for testifying against other defendants. Women get better plea deals than men do, they get shorter sentences than men do, their prisons are much more secure than men’s are, and their prisoners are a hell of a lot nicer.

Bail is supposed to be set based on the crime alleged, the defendant’s prior record, and any factors that indicate an increased probability of flight (dual citizenship, out-of-state residence, etc). That’s it.

Bond has little to nothing to do with the underlying offense. It is about 1) ensuring appearance for all future court proceedings relating to the charges, and 2) curtailing any danger to the community posed by the defendant. Personal history (especially violent conduct or prior failures to appear for court), connections to the local community (including family), and similar factors are given outsized importance. Without knowing more, it’s impossible to say what motivated the bail decisions. Could be just based on sex, but that’s not a given.

I’d like to propose a radical approach to this issue: Get the facts that the judge had.
Even if gender discrimination is rampant in the courts, that doesn’t mean that any given case about which you have mainly headlines is an example of that discrimination.
Which defendant’s priors are felonies, and how serious are they? Does either defendant have a history of not showing up as ordered by a court? Who has more ties in the local community? Who is a greater flight risk, according to the facts? What did the prosecutor say in court? The defense attorneys?
How on earth can you know what’s going on in this particular case without knowing the facts?

Recently I was the beach here in the north east of America and it was loaded with hot, slender girls. Perhaps all the skinny girls in America were at that beach that day or obviously fat girls stay away from the beach, but while it’s definitely true American girls are probably on average the fattest in the world, I do think the case is overstated for dramatic effect. In practice most circuit courts follow guidelines that take into account a more detailed list of factors.
The real injustice here is why they were required to pay money for a crime that wasn’t dangerous. I think it must be based on committing a lewd act in the presence of children. Bit of a stretch. I’m not sure the intent of the statute was to protect children from the “danger” posed by witnessing consensual sex in the distance.

Income and wealth could have played a role. Someone with a lot more money in the bank would be tempted to blow town. So if the person is less wealthy, you’d give him or her a lower bond.
Either way, it seems like a case where the judge could just fine them a grand or sentence them to two weeks of community service and save everyone a lot of trouble.
