Destroy The 9th Circuit Of Hell

Yesterday, the 9th Circuit of Hell ruled that the stay of Trump’s travel ban from seven Muslim countries (a stay for which a migrant-adopting cucked Judge Robarts in WA state literally made up the basis for out of whole cloth and feelz) was legal and would continue.

The traitors who sit on the 9th Circuit of Hell (headquarters: San Francisco, CA) essentially ruled that the President and the Executive Branch have no discretion to set the nation’s immigration policies. This is the unavoidable precedence that is established by their decision.

Allow me to cut to the quick with this leetle shiv I have at the ready:

The judiciary is corrupt. The shitlib-infested courts are black robed enforcers and propagandists of Democreep legislation and Democreep executive orders, and act as a “check” only on conservative legislation or Republican President EOs.

The courts, iow, are completely biased and partial adjudicators of the law, which they now define into existence as whatever meets the anti-White shitlib standard of excellence.

Checks and balances apply to the judiciary too, and we’re well past the time when the courts need to be brought to heel. Trump was elected by the people; judges are appointed. Trump has more legitimacy than the 9th circuit court because he is a more direct conduit to the American people’s voice.

I see three post-9th Circuit of Hell options for Trump:

  1. Follow his ban with more Trump EOs that shitlibs have to endlessly parry. (flood the zone)
  2. Wait for Gorsuch confirmation, and bring the refugee ban to SCOTUS where that court will HAVE to weigh in its favor, or lose legitimacy
  3. Crush the judiciary

Point 3 will require a GOP Congress that Trump can rely on to strip the judiciary of power, which is far from a given. There is also the quasi-military option; aka a show of force. Trump just goes ahead and commands LEO and other border authorities to follow his EOs and ignore the judges. And finally there’s the FDR nuclear option: threaten to pack SCOTUS and reduce the power of each individual justice.

Point 2 also requires faith in the sanity and loyalty of Judge Gorsuch to the American people. (we’ve been burned before by noms turned libshit….). Frustratingly, evidence has emerged that Gorsuch may be a crypto-liberal in the mold of David Souter.

Point 1 is the easiest for Trump to succeed with in the short term, but also the least damaging to the anti-White Left in the long term, for it leaves their stranglehold on the judiciary in place, and cauterizes the Left’s framing of the citizenship and border issues.

I’m partial to number three. Blow this mother up. Pat Buchanan and Daniel Horowitz agree: It is time to dismantle the 9th Circuit of Hell. And that is only the first step to get this activist globohomo judicial tyranny to bend the knee to Heritage America.

Immigration, borders, and the National Question are the Gom Jabbar/Pain Box and the Voight-Kampff tests of humanity rolled into one. Will the nation find its core humanness, or will it withdraw to nation-wrecking instinct and embrace a lack of empathy for fellow Americans?

Demography is the Left’s source of power. If they lose on the National Question, they lose on all the other globalist initiatives they want to visit on ordinary Americans, because no amount of miseries heaped on Heritage America is too much to the anti-White Left. This is why the Left will fight to the brink of Civil War II for their “right” to spread the Constitution thin enough to cover the entire world’s ingrate indigents.

Like Love, if you indiscriminately extend US Rights to everyone in the world, then Rights mean nothing.

Pathological altruism will kill us, or we will kill it. And killing an idea has historically all too often required….well, you fill in the blank.

    Anyone who hasn’t read Thomas Chittum’s Civil War II book should really do so. It was published in the early 1990s and he laid out almost exactly the ethnic and political tensions that would kick off a major conflict in the U.S. leading to a break-up.

    He even gave some rough dates for the problems to start: Around 2020 based on demographic projections.

    It is not a long read, but well worth the time. CH may want to do a book report on it.

      I read it in the early 2000s and was blown away. Read it again last year. I will say that we are definitely on the glide path still to big problems.

      The thing about his book is he lays out his experiences as a mercenary in Bosnia and the ethnic conflict there. He is very detached in his analysis and his end of chapter bullet lists of warnings signs reads like today’s headlines. In the early 1990s nobody would have thought what he was saying made sense.

        Kiss Me Deadly was great, but arguably because it subverted the genre by taking the hard-boiled tropes to an extreme. Spillane was pissed they turned the Mike Hammer character into an out-and-out asshole bully…but I suppose that’s the appeal, heh.

      I want to highlight Point 11 (Civil War Two Checklist), page 153

      here we go:

      “Watch for real political power to continue to shift from our elected officials to the courts, and thus away from the American people.”

      Book summary: All in all the president will have some busy schedule. If succesful, should get Nobel Peace Price. It is not unfair to say that if Trump succeeds he really deserves it. Obama deserved it too…well just do some surfing with your gay friends.

    The 9th circuit has been overturned 80% of the time by the SC. Much higher than average. Give it a few years for Trump to pick the judges. The only way to dilute its influence is to split the district – I heard there are proposals ready to be introduced.

    Until then: stay strong. It is a temporary issue.

    Trump has an embedded bureaucracy to fight – the judicial side of things is just the most obvious today. The real battle will come from within the executive branch.

      The left made a mistake by putting judicial reform on Trump’s radar. It was a back-burner issue, but in picking a high-profile fight with President Alpha, he now will be sure to focus on the destruction of the Ninth — adding personal reasons to the political.

      Forty years in the spotlight and two under hyperscrutiny as a national politician, and these leftwing faggots still can’t figure out how this man operates.

      Trump will rejigger the words now that he’s got his AG in place and defend it properly, mooting the reversals. Those who whine that he should have waited until his team was in place understand nothing about the importance of executive initiative and the need to be on permanent offense.

      Closer to home: watch who buckles on our side under this mildest of pressure. Loyalty is tested when there are setbacks, so much so that it sometimes makes sense to cause a setback just to see who has the mettle for the long-term fight. Poke a cuck and he tells on himself.

      I am sure Trump had a heart-to-heart with Gorsuch, and I trust the Presidentissimo until he gives me a reason not to. In the last 20 months he has not shown one sustained sign of wavering. Importantly, even when he tests out strategic appeasement, he always always comes around to the stronger position. Latest e.g., Elliott Abrams, Baker-Paulson carbon tax.

      The Ninth Circuit has the third-highest reversal rate in the Supreme Court of any federal court of appeals, behind the fairly conservative Sixth and Eleventh Circuits. The average circuit is reversed more often than upheld.

      Note the qualifier: “in the Supreme Court.” The Supreme Court only grants certiorari to a tiny handful of circuit cases each year, and it only bothers with those where it feels the circuit court may have made an institutional error of law. In other words, the 99% of cases the Ninth Circuit gets right end with the Ninth Circuit.

      The entire purpose of the judiciary is to make sure the will of the people – which is temporary and impetuous – doesn’t violate the Constitutional foundations of Western democracy you purport to want to save.

    I’m sure at some point in time, when the EO was drafted, it was known that it would come to this, that some rogue judge would do what he did and that it would in turn be reviewed in the 9th Circus Court and that they would do what they did.

    I’m sure the Trump admin was hopeful for the best, but at the same time, prepared for the worst.

    This is like his campaign all over again. Just when you think, “What’s Trump doing?” a few weeks later it all comes to fruition and you’re just wondering, damn this guy’s good.

    Two memorable examples: when he was hemming and hawing to the MSM about his stance on illegals and then smashes it to pieces with his Top 3 rally speech in Arizona and confirmed a wall would go up and deportations would be enforce.

    The other was when he said he’d speak about the Obummer birther issue. Got everyone riled up. Made, actually made, the entire MSM cover his groundbreaking ceremony at the DC hotel, wherein many military personnel were giving their support and endorsement for Trump and at the very end he says, “Obama was born here” and walks away.

    It would be exhausting but, couldn’t Trump in theory take all three Points? Also, has he appointed Judges yet? Has it been determined how many he will be able to appoint? Wouldn’t that make the whole thing go away? I was under the impression that 9th Circuit was just the Apellate Court of California. SCOTUS outranks.

      Trump could solve many problems, including the 9th circuit, by appointing a broad swath of judges across the country and in defiance of the Democrat political representatives, who, while customarily able to pick judges for their circuit, presently lack the votes to oppose passage of any judge Trump appoints.

      Trump should not merely pack the Supreme Court, he should pack every federal court in the country.

        If he can indeed make the appointments, I agree. It might take the bulk of his term but it would be worth it in order to do what he needs to do. Reading up on the 9th, it is a Federal Appellate court (one out of 13, it has hegemony across the West Coast, Guam and Mariana Islands.) It is a part of SCOTUS. They need to be replaced.

    I agree: Option 3. Have Jeff Sessions prepare an Attorney General’s opinion characterizing the 9th Circuit opinion as unconstitutional and unenforceable and possibly treasonble as assisting terrotist enemies to enter the United States.. Instruct all executive branch officials to disregard court orders unless specifically told to follow them by the Attorney General. Order the disarmament and arrest of any Federal Marshall attempting to enforce a court order on an executive branch official. Ask Congress to begin expedited impeachment proceedings against any judge or justice issuing an order impeding the enforcement, and to strip the federal courts of their jurisdiction to hear immigration cases. Appropriation bills can strip funding for all support staff and facilities for any judge or justice issuing an order impeding the function of the executive branch. (Constitution says you can’t reduce their salaries, although maybe they could be paid in Thai baht.)

    The establishment is, fundamentally, aghast that Trump won and will now do everything to stop him from governing, including the existential question of what type of nation this will be: white or turd-world. We’re now in Mad Max world where the question is the simple one posed by Master Blaster to Auntie Entity:

      There’s a single flaw in the plan though. If you remove federal jurisdiction from immigration cases, where does it go? States do not have (and presumably do not have the right to make) laws regarding immigration; given that individuals are citizens of “America” rather than a particular state. Also, even supposing that you handed it down to a state court, you’d have massive disorder as West Coast states handed down ruling after ruling in favor of “moar culerz” along with liberal East Coast jurisdictions (Mass, and NY come to mind).

      The real answer is for Trump to push it through to the SCotUS and have them definitively rule in favor of current policy. Then he can move to realign judges on Circuits.

        I pretty sure Diversity Heretic means to remove jurisdiction of the federal courts from immigration cases.

        Two of the three judges empaneled to hear the federal appeal of the nutcase’s opinion out of Washington state are semi-retired. Such retirement could be official if Trump would appoint replacements.

        Removing immigration cases from federal court jurisdiction would not affect the existing administrative apparatus governing immigration and naturalization–it would simply remove federal judicial review from the mix. State courts might try to get involved, but state jurisdiction is highly questionable in an area in which Congress has “occupied the field.” State court orders pertain only to that state, so they are not as pernicious as federal court orders and are easier to disregard.

        But the issue here is fundamental: Who run Bartertown: elected presidents and legislators or unelected, largely unaccountable judges and justices?

        Based on the above fact (I broke this apart due to moderation of 2 comments now), you can’t take jurisdiction away from a Federal court without allocating it somewhere else. States (since the creation of the USA) have not ever had (sorry wolfie, you’re wrong) the ability to oversee immigration.

        This is the other catch-22 of the way the system works now. If you want a particular result, you file your federal case in a particular circuit based on how you want the judges to rule (or expect them to, based on precedence… judges love precedence). The location (in your example, those judges in Wash state), has no bearing especially on the particular legality. The case in question could have been filed in the 1st, 2nd, 3rd, 9th or 10th for virtually the same results. The 9th is just particularly notorious because it encompasses the most “Blue” parts of the US.

        Federal courts may have national jurisdiction but you’re forgetting two points: (1) there is still the issue of venue–it may be the proper court but its not the proper place; and (2) court of appeals opinions have controlling precedential value only within the circuit in which they are issued. They have only persuasive precedential value in other circuits. It is not unusual for courts of appeals to divide on issues, as they did on the constitutionality of Obamacare before the erroneous ruling of the Supreme Court. But I still favor a hardline approach–the Ninth Circuit evidently thinks the First Amendment is implicated, which makes the issue the interpretation of the Constitution, and there the Supreme Court has had the final say since Marbury v. Madison. And furthermore, this is a fight for the soul of Americans to resist racial dispossession and eventual extermination.

        Ok DH, I think we agree in principle, but without this ruling the case couldn’t advance to the Supreme Court. Our system doesn’t allow for cases to be filed in the Supreme Court. They have to be created in lower court, advancing past the various under-level Circuit and appeals process. It’s a “safety valve” of a sort intended to prevent abuse of power, as the Supreme Court is the final court of appeal; our founders were wisely aware of the fallibility and weakness of justice in the face of final authority (see King George III).

      Trump understood the need to address the corrupt judiciary abstractly, but now the Ninth has forced it into sharp focus. I suspect Buchanan’s well-articulated pique is widely shared in the White House, specifically at the Resolute Desk. They poked a sleeping lion on this issue.

      And the Republican Congress, at least on paper, has been looking for the momentum to use their Article I.8.9 prerogative to go after the imperial judiciary, their cultural bête noire.

      Conservatives led by and fueled with Trump’s high-energy wrath finally gives a LAWFARE counterattack its best chance of success in a generation or three.

    Also, Trump managed to outfox the shitlibs again by putting out this travel ban as a bright shiny object for them to bark at. But the heart of the EO was actually unharmed:

    1) The provision that slashes refugee admissions from 110,000 to 50,000 (of which 34,000 have already been brought in this fiscal year) is still in place. The refugee racket will be forced into painful cutbacks and shutdowns.

    2) Robart’s ruling only applies to refugees that had already been approved for admission by the State Department to the United States. He has no control over whom the State Department considers for admission going forward; only Trump does.

    3) The State Department is now only conducting interviews for the spouses and children of previously approved refugees, and for religious minorities (Middle Eastern Christians). In fact, reports indicate that State has even apparently stopped interviews for those asylum seekers that Australia is holding.

See the premature celebrating in Hillary’s “3-0” tweet, get the rainbow lights ready!

        He will adjust some language in the order, moot the overturning, test it in a friendlier court, and get the victory after a month delay — a delay which he can now vividly characterize as the judiciary’s attempt to undermine not merely sensible immigration policy but national security itself.

        More important, however, is to guard against precipitate demoralization upon every “news” event that isn’t an instant and obvious win. It’s like battered-wife syndrome, flinching every time your abuser scratches his shoulder. Go watch The Burning Bed to remind yourself what Trump is doing to the media and its addict-promulgators.

The two are, or at least were, very close and reported very positively about each other. I think we should give Gorsuch some credit, a man’s friendships say a lot about his character.

      Gorsuch is fine for the job for which he has been designated — and only the job. He sucks at politics.

      I’ve long said that if we ever get another Souter (or Warren or Brennan or Blackmun or Stevens or even an O’Connor or Kennedy), then it is open war on the Third Branch, complete with impeachments, jurisdictional curtailments, and congressional restructurings. The rumblings of which we are seeing in microcosm with the Ninth Circunt overreach.

      But we haven’t had a turncoat since Souter, and that was nearly 30 years ago. Ever since The Borking of Bork and Thomas, we have slowly learned how to slip past the nomination process traps, which Gorsuch’s perhaps deliberate “gaffe” is arguably an instance of. And ever since the Souter cipher, we have learned how to vet nominees properly — not with a “trust me, he’s one of us” backslap but rather via a paper trail of their judicial philosophy in action, which Gorsuch has in spades.

      CJ Roberts, for all the shit he gets over the Obamacare rulings, has demonstrated he understands the threat of a politicized judiciary to its quasi-sovereign status among the balance of powers. In fact, his Obamacare concurrence is an example of restraint. From the opinion:

      Those decisions are entrusted to our nation’s elected leaders, who can be thrown out of office if the people disagree with them. It is not our job to protect the people from the consequences of their political choices.

      There is not a chance in hell he allows the highly-politicized Ninth Circus shenanigans to stand, even with the 4-4 split. There are many instances not just of USSC overturning the 9th, but of doing so unanimously when the reputation of the judiciary is at stake. Roberts has dedicated his leadership of the court to check itself before it wrecks itself. “[I]t’s [our] job to call balls and strikes and not to pitch or bat.” As the Chief Justice of the United States (not merely SCOTUS), he should be champing at the bit to take this case and demonstrate his bona fides once again against the imperial judiciary.

    Been trying to deprogram liberals. Putting aside Jews and minorities (special cases), I see 4 classifications of WHITE liberals. Many have qualities of more than one (status liberals can also be dreg or empathy liberals), but there is usually a dominant classification that you can focus on.

    Status Liberals – They want the most status for the least cost, which is very psychologically exploitable. They’ve been convinced through a rigorous propaganda campaign at schools, work, advertising, movies, etc. that being a liberal is high status and noticing differences between races is low status. Easy choice for them… just be a liberal and presto… you are now high status. These people can be smart and successful… but they are never as smart as they think they are.

    How to turn them: Forget facts. They need to be convinced liberals are low status. Without taking over Hollywood its impossible to do this alone, these people are heavily warped. But you can do it on a micro scale. Press the buttons. Liberals = losers, over and over again. Remember, they think they are above manipulation, so the more subtle you are the better (thats how the other side brainwashed them in the first place.)

    Dreg Liberals – Rejects of society who would be crushingly low status under a traditional, fact-based societal order. So they turn to lies of liberalism to lower the psychological cost of how unworthy they are.

    How to turn them: You can’t. If you were able to successfully convince them of facts, the hit to their ego would be so big they might off themselves. If you get them to admit a fact that counters liberalism, they will have amnesia about it the next time you talk to them. Just avoid them. (This means unfortunately lotta women are hopeless and can’t be converted away from the liberal cult. Excessive cock mileage makes budging from feminism psychologically impossible for them.)

    Empathy Liberals – Usually young daddysrich white women who have lotsa empathy to give due to their station in life. Has been manipulated their entire life into directing their empathy towards groups of people with no civilizational value.

    How to turn them: Visual evidence of anti-white crime. Show them how Islam treats women. A white female Trump voter got pepper sprayed by antifa? Bookmark it and show it to empathy liberals. A true empathy liberal is the easiest to turn but they are rare. Scratch what you think is an Empathy Liberal and you usually find a Status Liberal or slut Dreg Liberal underneath.

    Blissful Ignorance Liberals – These are usually young. normal, sane Fucking White Males with slightly above average IQ.This is your classic liberal-who-turns-conservative later in life. Taught liberal crap and only become conservative later in life when they see the taxes in their paycheck, or when they try to start a business and get crushed by regulations, or when they get mugged, or when their daughter looks at a black guy.

    How to turn them: Like I said, with the right impetus they’d eventually slide towards shitlord. Your job is to speed it up and take them deeper than they’d ever go. Burst their bubble. Red pill them hard. Visuals are best. These are your best hope for real recruits to our side. Be prepared with status visuals, too.

    Congress needs to get some balls. One of the members should propose a bill similar to the 1924 Johnson-Reed Act, which barred a lot of undesirable people from a lot of undesirable countries. It was undone by the awful Hart-Cellar Act of 1965, but there is no reason a new bill couldn’t be proposed — esp. with a Republican majority.

    One of the things Johnson-Reed did was stop the influx of Italians. Sure, it’s amusing now to watch all the Hollywood films about the Mafia, but think about how awful the country must have looked to citizens who grew up in 1890s rural farmerica, only to find their country had turned to Gangsterland by 1925.

It really got ramped up in the early days of the Civil Rights movement, where the ‘Supreme’ Court first starting using the Commerce Clause of the US Constitution as a justification to support anti-discrimination laws (which the US Government had NO legal basis to do under the Constitution…which provided instead for freedom of association, which means freedom FROM association, too), saying that discrimination in public facilities impeded interstate commerce because travelling negroes could not eat in Whites-Only establishments, etc., etc. Total bullshit. People now just accept all of this, as if the Constitution actually says discrimination against blacks, or anyone else, is wrong. It does NOT. And Due Process only demands that you treat people similarly situated the same IN THE EYES OF THE LAW (NOT socially), so that, for example, if a black person and a White person both spit on the sidewalk, the fine should be same for each, regardless of race. You get the point. Anyhow, liberals today believe in the idea that the Constitution is a LIVING document…which means they do not have to bother to go the tedious route of amending it, instead they will just interpret it as they see fit to serve their ends, and get their buds on the Supreme Court who will see it that way, too.

    #3 is out of the question so long as Congress is infested with traitorous moles for the Left (aka, Cuckservatives) like John McCain, Paul Ryan, et al.

    I thought about this, and gave consideration to the following:

    1. Use a straw man to file suit against new EOs in conservative forums (that is, after all, what the Left is doing – forum shopping), and get a positive ruling in order to proceed. However, this is playing by (((their))) rules and would be a long, drawn out process. Also, it most likely would be an actionable ethics violation against the AG and possibly a grounds (as if they need any) to try to impeach Trump if this ruse is uncovered. Unfortunately, the Left is allowed to forum shop to attach EOs and legislation, but the government is not allowed to proactively do the same.
    2. Have a press conference and say, “I tried to be a little compassionate, as some have advise me to do, and only deport illegal aliens and those who have overstayed their visas, focusing on those who have committed felonies and serious misdemeanors, or otherwise present a danger to society (like gang members). But….sadly….I see that there is no working with the entrenched Left who do not have the best interests of this Nation and its citizens at heart. Many of these people sit in black robes in blue states, or are State Attorney Generals. I am scrapping that idea, and ordering 10,000 more ICE employees, and will be deporting all here illegally. I am also ordering that no more funding go to any state, especially California, that have ANY sanctuary cities or provide any legal standing to illegals (including driver’s licenses). I am also halting, indefinitely, the issuance of any NEW visas to any of the mentioned 7 nations.
    3. Gut the Department of (mis)Education. Fire them all except for those few loyal to the cause, and to turn the lights off and on at HQ.
    4. Withdraw all foreign aid to ALL nations, including Israel. How’s THAT for nondiscrimination (sorry, Jews, but you asked for it!).
    5. Make PUBLIC arrests of top executives of corporations that have clearly and callously been flaunting US laws by hiring illegals.
    6. Go on the warpath against Mark Fuckerfag.
    7. Declare George Soros an Enemy of the State, and Persona Non Grata, for his clear financial and logistical support to the rioters for the past umpteen years. Forbid him to enter the USA or any US Territory under threat of arrest and imprisonment.

    That’s just a start. God, I wish I were on his Cabinet!!!
