At one point in his piece Volokh asks why defense attorneys aren’t kicking up more of a fuss, and I have a thought.
As with, say, many defenses that would be available for firearms offenses, your average criminal defense attorney is a flaming liberal who abhors guns in any event and thinks nobody should have them. So, in defending a client with gun charges, the creative muse doesn’t pay a visit.
Maybe the same lack of inspiration affects them when their client is facing a “racial incitement” charge in Connecticut.
There are a lot of sclerotic institutions in America that need a mass culling of lunatic shitlibs within their ranks.
This subject is eminently important. The whole malicious rhetorical foundation of “hate speech” needs to be discredited. It was a concept invented by YKW and their shitlib suckup lackeys with the eventual goal of silencing their critics, as we can see happening today.

While “hate speech” is technically not a 1st Amendment issue (for now), it has been given a degree of legal legitimacy due to “terms of service” for various platforms and social media, as well as most corporate HR departments, who expressly prohibit “hate speech” in their employment contracts (both in and outside of office hours).
The left is also pushing to make this a 1st Amendment issue by trying to equate “hate speech” or “ethnic intimidation” with “fighting words”, a well-established exception to free speech.
In countries like Canada, Human Rights Tribunals have created a massive loophole in freedom of expression (which has a long tradition of being heavily restricted there).
Rather than being reactionary and constantly on the defensive, the right needs to push its own ideas in such a way that we believe in their inevitability. This is precisely what the left does (I believe Lawrence Auster had a quote to this effect).

Most Defendants don’t have tens of thousands of dollars to pay their attorney to mount a facial challenge to the constitutionality of a particular criminal statute, i.e. where the entire law itself is called into question, as opposed to an individual’s constitutional rights are violated based upon unique facts. In the former case, you have to notify the Attorney General of the state you’re in, and they will vigorously defend the law utilizing the seemingly unlimited resources of the state and you are guaranteed to have the matter tied up in appeals to the highest state court for years. Such facial challenges are typically subsidized by special interest groups (the NRA, ACLU, NAACP, etc.). There simply is no deep pocket lobbying/litigation arm of any organization willing to question the application of “hate crime” laws. So I suspect, this, more than anything is why these types of cases aren’t challenged.
